OPU won another court case of the so called push-back (prohibited refoulement) on behalf of a Kurdish family arriving at the Prague airport in December 2016 (cases No. 4 A 33/2017 and 4 A 32/2017) The police in a fast “procedure” without interpreter refused to accept their asylum claim even in case of a family arriving with valid visa. The police misconduct and refusal to accept asylum claims happens routinely at the Prague airport,which is in breach of articles 31 and 33 of the Geneva Refugee Convention. OPU was successfull several times at courts including the Supreme Administrative Court in challenging the unlawful procedure of the aliens police. However, this systemic problem must be addressed by the responsible Ministry of Interior to stop the future police violations of Czech and international law.
