The Court of Justice of the European Union confirms the opinion of OPU lawyers!

The Court of Justice of the European Union has sided with refugees from Ukraine who were refused temporary protection by the Czech Republic. In Case C-753/23 Krasiliva, the Court ruled that Czech legislation was contrary to European law. This gave the benefit of the doubt to NGOs that had repeatedly pointed out the contradiction of Czech legislation.

The Ministry of the Interior refuses to grant temporary protection to refugees who have applied for temporary protection in another country before arriving in the Czech Republic and have not yet received it. The Court of Justice has made it clear that EU law does not allow such a procedure. Furthermore, it stressed that refugees should be able to defend themselves in such cases in court.
